Introduction

Jutlander Group ApS ("Jutlander Group", "JG", "we", "us", “our”) provides a service ("WhiskyBazar", “WB”) at: WhiskyBazar.com, for resellers ("Reseller(s)", "Auctioneer(s)", "Dealer(s)") for dissemination of sales of spirits, including whisky, between private sellers ("Seller(s)", "Collector(s)", “he/she”) and buyers/bidders ("Buyer(s)", "Bidder(s)", "User", “he/she”), collectevliy refferd to as: "User(s)", "You", "Individuals", "Person(s)", "Collector(s)".

It is not allowed to indicate or distribute/publish incorrect, misleading or harmful information of any kind. Any product, profile, payment card and address information etc. must be stated as correct and truthfully as possible.

It is required of all Users to be aware of and agree to all updated Terms & Conditions including our Privacy Policy (collectively referred to as Terms); These can be found on the website or through the following links: Terms & Conditions and Privacy Policy. If You do not agree with all JG’s Terms, do not use the service.

Who are allowed to use WhiskyBazar?

When using WB, You must be at least 21 years old and be legally authorized to enter into this agreement. Furthermore, You must be from a country that allows access and usage of alcohol from the minimum that age.

Only Individuals/Dealers from countries specified in our system (when creating a profile) are allowed to use WB, and the trade is only allowed between these countries. For countries/areas with restrictions on imports of spirits, including the United States, the Buyer/Bidder is required to ensure that the item can be legally imported to the desired shipping address, as well as being aware of/agree with current legislation before bidding/purchase.

Buying

This section provides information for potential Buyers and Bidders. Before you bid or purchase any items, please read through our terms, including details about fees, payment, and shipping.

Auction prices

All prices are quoted in € (EUR) incl. VAT but excl. shipping, unless other is stated during the auction. VAT is charged where applicable, includes shipping, but not on the winning bid. The Buyer with winning bid is charged with a fixed auction fee of €4.00, 7% of the winning bid, shipping costs, insurance (optional) and possible exchange fees. Buyers within the European Union are currently not obligated to pay for bank- or transfer fees.

Expenses for export, import VAT, customs duties, local taxes and fees are borne by the Buyer. For current legislation and rules, including Customs and import VAT for spirits, please contact your local authorities for a correct answer before bidding.

Webshop prices

All prices are quoted in € (EUR) incl. VAT but excl. shipping, unless other is stated. VAT is charged where applicable. Buyer is charged with shipping and insurance costs (optional, see section “Insurance of goods/items”), as well as import, customs and exchange costs. Buyers within the European Union are not obligated to pay for bank- or transfer fees.

Payment

A purchase/auction must be paid in € (EUR) by debit card VISA, Maestro, or Mastercard. Non-EEA cards may be accepted but will be subject to an additional fee of 3% on top of the winning bid. The amount is automatically raised when the item is shipped. Payment card information is sent encrypted via a secure SSL connection.

Payment must be completed no later than three days after auction end. Late payments will raise an extra fee of 3% of the winning bid.

Jutlander Group utilizes Gate2Payments.dk and QuickPay, both approved as payment services and for encrypting any account-details with an SSL protocol.

Bid on auction

A bid commits the User to pay up to max-bid +7% of the bid and a fixed fee of €4.00, plus any costs for shipping as well as export, import, customs, and local taxes. Items are sold to the valid winning bid at the end of an auction.

All bids must be placed in € (EUR), cannot be less than the current/minimum bid and must be placed in whole numbers (no decimals). Shill bidding is not allowed, which includes bids on items with relations to the Seller, as well as own or acquainted items.

For auctions that have achieved valid bids, the remaining time before the auction ends appears; only within this time can bids be registered (bids after that are not taken into account). It is the responsibility of the User, that bids are properly submitted and registered before an auction ends (no later than 1 hour before the deadline is recommended)!

Users should evaluate the product at the auctioneers’ place before bidding. There is no responsibility for the Buyer’s claims due to its inadequate ability to assess an item, if it can be considered as reasonably described For questions about an item, the Dealer should be contacted before bidding.

In the case of discrepancy between item description and images, please contact the Dealer before bidding.

Insurance of items

If insurance will be utilized, please retain all packaging material for documentation, until the case is settled. For orders/auctions with no shipping insurance, refunds cannot be offered due to damage/loss during transit.

Items handed over to an auctioneer must be insured by the owner/seller, unless other is agreed upon on a written agreement.

Shipping, Delivery & Returns

This section provides information about shipping, delivery, and returns (rights of withdrawal). Before you place any bid or purchase an item, ensure to inspect the item sufficiently, as there are no withdrawal rights on auctions. Furthermore ensure that the item can be shipped to your destination and that you agree with our terms, including shipping payment, import fees (if relevant) etc.

Order shipping

For all sales and auction items, the Auctioneer/Dealer will ship the item within five days of a sale/auction’s end, provided payment has been completed by the Buyer. Packing labels can be accessed (by Auctioneers) for each item at WhiskyBazar.com when paid.

Requirements for packaging

The Dealer holds any expenses for packaging material and is responsible for adequate packaging, cf. guidelines for packaging, thus minimizing damage during transportation. The following step-by-step guidelines apply for packaging:

  1. Safely wrap the Bottle + Original box (if included), in Air Bag packaging or Bubble Wrap (min. 3 layers).
  2. Place the item in a High-Quality Waterproof bag. Ensure that no sharp edges can damage the sealed bag.
  3. Place the item centred in a double-layered corrugated cardboard box. Ensure that paper filling materials properly cover all 6 surfaces and fixes the item inside the box.
    NOTE: For prices above €500.00, use additional spacers or foam profiles for corner protection (before paper filling).
    Max dimensions of a box: 30 x 30 x 50 cm.
  4. Include buyer’s invoice inside the package. For shipping outside the EU, attach 3x buyers invoice in a delivery note pocket outside the package. Add shipping label and deliver to the package store.
    NOTE: Mark the box with symbols: “This side up” (cf. the item’s orientation) and “Fragile Goods”.

Required information on packages

The Dealer is responsible for correct and sufficient indication of the sender/recipient information on packages, including the attachment of a purchase receipt.

Information about Buyer, including contact information, shipping and billing address plus package label and purchase invoice/custom’s documents (if required) are available under each item at WhiskyBazar.com.

Submission of packages

When the package is ready for shipment, it is delivered to a package store by the Dealer/Auctioneer no later than five days after a sale/auction’s end, given that the Buyer has completed the payment. Hereafter the package will be marked as shipped in WB by the dealer.

If the Buyer wishes to pick up the item at the dealer’s location, this must be stated during payment (optional). Pickup at the Dealer-location must occur within 10 days after a sale/auction’s end, and the Buyer must be able to provide proof of payment and receipt before the item can be handed out.

Delivery destinations and durations

Delivery of goods takes place with freight company (collaborator) and only to areas/countries specified in WB (see table below). Delivery time depends on the sender’s and recipient’s country but is not expected to exceed three weeks (may last up to three months). Delivery to islands detached from mainlands (no bridge) is not possible.

If the Buyer is unable to be at the delivery address, permission can be granted (through external service) that the package can be placed in the garage, carport, etc., at Buyer’s responsibility. Additional expenses associated with pickup or delivery of the package due to the Buyer’s inadequate ability to receive the package at first delivery is borne by the Buyer.

If the item is damaged at the time of delivery, please contact JG via. email. The provisions of the Buying Acts may apply if the goods are inadequate.

Right of withdrawal

The right of withdrawal applies only to private Buyers within the EU through normal sales. There is no right of withdrawal when bidding on auctions or when buying from outside the EU. Therefore we encourage any user to visit the respective auctioneer (within the opening hours) and inspect the item before bidding. For general sales (webshop) the Dealers’ terms due to Buyer’s right of withdrawal will apply. Business owners have no right of withdrawal.

The Buyer’s right of withdrawal is 14 days from date of delivery. To apply the right of withdrawal, the Buyer must notify his decision in an unambiguous written statement to JG, with an indication of the order ID, hereafter we will confirm. The associated template for “Default withdrawal form” can be used, but is not a requirement.

The cancellation deadline is complied with if the Buyer announces the exercise of the right of withdrawal before the expiry of the withdrawal period. In exercising the right of withdrawal, the Buyer will be refunded the order-payment; shipping costs, transfer fees will not be refunded

We will hold the refund until 14 days after the returned item has been received. The Buyer holds the direct costs associated with the return of the goods. Refunds are made with the same payment method as that used for payment for the transaction.

All returned items incl. original packaging must be returned to the Dealer in the same condition and with the same shipping company as it was delivered with. The right of withdrawal lapses if the item, package or sealing is broken. In case of impairment of the item as a result of Buyer’s handling, this amount will be deducted from the Buyer’s refund (up to the selling price).

Buyer is responsible for items until we receive them, including storing documentation that items are packaged properly and shipped. Upon repeated use of the right of withdrawal, we reserve the right to terminate any cooperation/user account.

Selling

This section provides information for Users/Collectors that want to sell some of their whisky. Before any item is requested for auction or is put on sale, please be aware of our terms, including which items we accept, selling fees, payment etc.

What can be sold?

The only spirits that may be sold on WhiskyBazar are whisky unless otherwise stated. All items incl. content must be original (not copied), unopened and with unbroken sealings.
All auction items, including the dealer’s auctions, must meet the requirements for goods sold under: "Profit margin - collectables and antiques - the buyer cannot deduct VAT".

For all items, labels, sealings and original/attached boxes must appear in reasonable condition and all text must be legible. The liquid state/filling level of the bottle must not be below the bottleneck and should correspond to the original liquid state. Bottles must not have leaked and must be in good condition and safe to ship/export. In case of doubt, contact: Support@WhiskyBazar.com, before the sale-/auction is published at WB.

Price and valuation

Seller’s valuation should not differ significantly from current market/auction prices for similar items, and maybe agreed in consultation with the desired retailer.

If the Seller enables the Auctioneer to adjust the starting bid, the Seller is then obligated to accept bids on that amount, if the item is delivered to the Auctioneer.

Sale’s expenses and fees

Upon settlement, the Seller pays/issues a commission fee of 7% of the winning bid and a fixed handling fee of €4.00. The settlement is only made in € (EUR) or DKK if the seller is Danish. Seller is not charged with the bank or transfer fees but exchange fees are borne by the Seller. Once listing-price/reserve-price fees are introduced, these cannot be refunded once the item has been on the live auction.

Create auction item

The seller describes the product as fair and as truthfully as possible, selects an auctioneer to handle the auction, indicates the starting bid and runtime after the first valid bid. If the runtime is set to one month, the auction will end 30 days after the first valid bid has been received.

Sellers are only allowed to submit legally acquired items, at which they hold the full unrestricted ownership.

Delivery to dealer

At Dealer’s acceptance to handle an auction, the Seller must within 5 working days agree on the delivery date/time. It is expected, that the Seller at his own expense is responsible for delivery to the Dealer unless they agree differently.

When the Seller hands over the item to the Dealer, the Dealer must mark the bottle as received in WB.

The Seller should always have photo documentation of the item condition, as well as a physical receipt for handing over the item to the Dealer. Such receipt should at least contain a full description of the item, the minimum price, notation of date as well as Seller’ and Dealers’ signatures. A physical receipt is the Seller’s documentation that the item has been handed over to the Dealer; a template for such receipt may be accessed in the Templates section.

Payment of the seller profit

The Seller’s profit is paid only in € (EUR) or DKK if the seller is Danish. Payment will be made to the specified account number within 7 days of the expiry of the buyer’s right of withdrawal (if applicable), provided that the buyer does not cancel the transaction and that both the Buyer and the Dealer comply with their obligations.

The expected time horizon for payment is approx. five weeks after an auction’s end, but may last up to four months under special circumstances.

Revoke an auction

When an item is put on auction, it cannot be revoked. Auction items that do not receive valid bids after 3 months in an auction must be returned to the Seller (bottle owner) at it’s/or the Dealer’s/JG’s request. Seller’s payments/fees for an item’s listing-price/reserve-price among others will not be refunded once the item has been on the live auction.

We reserve the right to cancel an auction if we consider it inappropriate due to suspicion of error, abuse or otherwise.

Dealer

Formal requirements

Any retailer (Dealer, Auctioneer) associated with/joining WB must be a registered company with a physical store and be able to communicate in English, as well as be available for communication via email and phone to a reasonable extent. Dealers must offer potential buyers/bidders (at their request) an opportunity to evaluate an auction item in their store before bidding. Furthermore, Dealers must be validated for international import/export in their country.

It is important that any Dealer in our system is aware and agrees with our Terms and Privacy Policy. Furthermore, it is the responsibility of the Dealer to be familiar with and comply with applicable data processing agreements and accounting requirements for the sale of own goods/auctions, as well as auctions/sales on behalf of others.

Inquiry at auction

Upon request for managing auction, it is the responsibility of the Dealer to determine whether the item’s overall description, including price, appears reasonable. Comments or corrections to an auction must be communicated to the Seller before the item is accepted.

Receiving items

It is the responsibility of the Dealer to confirm the item condition is as expected when the item is handed over, and at this point evaluate whether the product meets the JG’s minimum requirements (see section: “What can be sold?”). In case the item is approved, it will be marked as received in WB by the Dealer. If not, the item/auction must be rejected.

Start auction

When the item is marked as received and thus validated, the auction can be activated and published in WB. When an auction is activated, it cannot be revoked. The Dealer must be aware that the item’s featured condition - which will appear on WhiskyBazar.com - is as accurate as possible, cf. the current condition of the product.

Delivery to the store

When the auction has ended and the item has been packaged according to WB packaging guidelines (See section: “Shipping of goods”), the item must be delivered to a package shop.

Dealer’s profit

For auction sales, the Dealer’s/Auctioneer’s profit is 10% of the winning bid plus €10.00. The profits are subject to VAT. The dealer is not charged with the bank or transfer fees. Exchange fees are borne by the Dealer.

Settlement with Dealer

The settlement is only made in € (EUR) or DKK if the dealer is Danish. The settlement is carried out monthly for auctions and sales where the buyer’s withdrawal right expires (in the present or previous month).

Payment will be made to the specified account number after the expiry of the buyer’s right of withdrawal, provided that the buyer does not cancel the transaction and complies with his obligations.

Other responsibilities

When the Dealer has received and accepted an item, it is the responsibility of the Dealer that the item, including packaging/boxes, do not disappear or get damaged. In case of loss or damage, it is the responsibility of the Dealer to cover the seller’s loss of up to 93% of the minimum price minus €4.00 and notify JG in writing of the event.

The Dealer is fully responsible for any trade made in the course of his business, including claims for damages and product liability unless the claim is solely attributable to lack of our responsible behaviour.

It is the Dealer’s responsibility to meet claims from the Buyer or Seller for compensation or otherwise. If the Buyer/Seller raises claims against JG, the Dealer will according to JG’s claim, cover the settlement corresponding to the Buyer/Seller’s claims.

For sales/winning bids above €2,000.00, the Dealer must contact Jutlander Group to determine if additional shipping insurance is needed before the item is shipped.

Other

In addition to the generally applicable rules for trade liability and what is described above, the following terms will also apply.

Profile Security

It is the responsibility of any User (including Dealers) that others may not access their profile or data. Access to a user profile by others is solemnly the responsibility to the user. This includes paying for goods being auctioned and sold at the specified price.

Reservation

There are reservations for sold out items and typing errors.

Disclaimer

We strive to keep WB in operation, but will not be responsible for breakdown or temporary shutdown unless a direct financial loss can be documented by the Dealer, Seller or Buyer.

We reserve the right, without liability, to edit data for an item/auction, if we find it appropriate, and to exclude any User or Dealer from the WB without any reason or claim for compensation. Subsequent usage of WB by the excluded part is not allowed before written permission is granted by JG.

When updating Terms, certain bids may be cancelled. Due to bids that are not correctly registered, the Bidder must provide documentation to JG immediately after, that a bid has been placed before the auction ends.

We reserve the right to contact any User with information we find relevant. This includes (but not limited to) email notifications about won auctions, pending payments e.g., even though the user doesn’t want to receive our newsletter.

Twists and disputes

Any twist or dispute will be solved amicably and constructively between the involved parties. If this is not possible, any dispute will be settled by the court in Aarhus (Denmark).

Appeals

For European users, complaints may be filed via the EU Commission’s complaint portal here. When submitting a complaint, our e-mail address must be stated: Support@WhiskyBazar.com.

Updates

When updating our Terms, we will send an email to our registered users at their provided email accounts. We also encourage all users to keep up to date with our latest terms, which will be available via the following link, one week before applicable.
